Well, well, well, what is all this then? You're claiming the defence of earlier intent to purchase? Frank's Bay Rum? I must say that in the circumstances I am not feeling very charitable. Not very charitable at all. (did I mention my medical condition?). I would say this all hinges on the very tiniest of technicalities, that being, did you actually place a firm and binding order with Frank for the "delayed" Bay Rum such that there was an offer, acceptance and consideration thus resulting in the formation of a binding contract of purchase and sale, albeit a contract with an indeterminate date upon which the contract would be performed? If you can establish all of this to the satisfaction of the tribunal, aka the DFS mob, then you would still be considered under Damn Fine Restraint for 2023, however, if you can only establish that you had the intention in 2022 to acquire the Bay Rum at some indeterminate point when it became available (to some at least) but did not actually place the order and make payment until after midnight December 31, 2022 then you are out. Technically. If this is the case, we'll let you continue as if you were in notwithstanding being out. We would do that because we are what is known as "good guys"
